By agreeing to these Terms of Service, you represent that you are at least of legal age in the state or province in which you reside, and you have given us permission to allow minors who are your dependants to use the Services on devices that you own, purchase or manage.

When you place an order, you are making an offer to buy. MyWallsy reserves the right to accept or reject your order for any reason at its sole discretion. Your order is only accepted once MyWallsy has confirmed acceptance. We must receive and process your payment before your order is accepted. Please check your order carefully before submitting it, as MyWallsy may not be able to process cancellation requests once an order has been accepted. In the event that we do not accept, amend or cancel an order, we will endeavour to notify you by contacting the email address, billing address and/or telephone number you provided when placing the order.
Your purchases may only be returned or exchanged in accordance with our Refund policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICING AND BILLING
Prices, discounts and promotions are subject to change without prior notice. The price charged for a product or service is the price applicable at the time the order is placed and is stated in the email confirming your order. Unless expressly stated otherwise, the prices quoted are exclusive of taxes, shipping and handling costs, and customs or import duties.
Prices in our online shops may differ from those in physical shops or in online shops or other shops operated by third parties. We may from time to time offer promotions on the Services that may affect pricing and which are subject to terms and conditions separate from these Terms. If there is a conflict between the terms of a promotion and these Terms, the terms of the promotion shall prevail. You agree to provide up-to-date, complete and accurate purchase, payment and account details for all purchases you make in our shops. You agree to update your account and other information, including your email address, credit card numbers and expiry dates, promptly so that we can complete your transactions and contact you if necessary.
You represent and warrant that (i) the credit card details you provide are true, correct and complete, (ii) you are duly authorised to use such a credit card for the purchase, (iii) charges made by you will be honoured by your credit card company, and (iv) you will pay for charges made by you at the stated prices, including shipping and handling costs and all applicable taxes, where applicable.
SECTION 5 – SHIPPING AND DELIVERY
We are not liable for delays in shipping and delivery. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs clearance or events beyond our control. Once we hand over the products to the carrier, title and risk of loss pass to you.

Our Services, including but not limited to all trademarks, trade names, text, displays, images, graphics, product controls, video and audio, and the design, selection and arrangement thereof, are the property of MyWallsy, its affiliates or licensors and are protected by US and foreign patent, copyright and other intellectual property laws.

The names, logos, product and service names, designs and slogans of MyWallsy are trademarks of MyWallsy or its subsidiaries or licensors. You may not use such trademarks without the prior written consent of MyWallsy. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans appearing on the Services are trademarks of their respective owners.

You may access third-party customer tools offered as part of the Services, over which we have no control or input.
You acknowledge and agree that we provide access to such tools “as is” and “as available”, without any warranties, representations or conditions of any kind and without any endorsement. MyWallsy is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases you make in our Shop are made directly with MyWallsy. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of a sale between you and MyWallsy, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with MyWallsy.

All personal information we collect through the Services is subject to our Privacy Policy, which you can view here, and certain personal information may be subject to Shopify’s Privacy Policy, which you can view here. By using the Services, you acknowledge that you have read this privacy policy.

Furthermore, you agree not to: (a) upload or transmit viruses or other malicious code that will or may in any way affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm or impersonate on the Services; (e) use robots, spiders, scraping, data collection and extraction tools, automated devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services; or (f) disrupt, circumvent or bypass the security or authorisation features, robot exclusion headers or other measures we use to restrict access to the Services. We may terminate this agreement or your access to the Services (or any part thereof) at any time at our sole discretion and without prior notice, and you remain liable for all amounts due up to and including the date of termination.
The following sections shall survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy and other provisions which by their nature are intended to survive termination.

WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. IN SOME JURISDICTIONS, THE EXCLUSION OF IMPLIED OR OTHER WARRANTIES IS LIMITED OR NOT PERMITTED, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

You agree to indemnify, defend and hold harmless MyWallsy, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against any and all losses, damages, liabilities or claims, including reasonable legal fees, payable to third parties arising out of or in connection with (1) your breach of these Terms of Service or the documents referred to herein, (2) your violation of any law or the rights of any third party, or (3) your access to and use of the Services.
We will notify you of any claim eligible for indemnification, provided that a failure to notify you promptly shall not relieve you of your obligations, unless you are materially prejudiced. We may arrange the defence and settlement of such a claim at your expense, including the choice of legal counsel, but shall not settle any claim requiring non-monetary obligations on your part without your consent (which shall not be withheld on unreasonable grounds). Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.  These Terms of Service and any policies or guidelines posted by us on this site or in relation to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, and supersede all prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, all previous versions of the Terms of Service).
